General Terms and Conditions
1. SCOPE AND SUBJECT MATTER OF THE GENERAL TERMS AND CONDITIONS
These General Terms and Conditions apply to all activities of RAFAEL SERRANO YOGA, hereinafter referred to as the Service Provider/Organiser, including yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., as well as to any other contracts not expressly mentioned which are connected with the aforementioned business activities.
The Service Provider primarily provides paid services in the field of yoga. These General Terms and Conditions (GTC) apply to the purchase of any services by participants, regardless of how these services are obtained from the Service Provider, whether by telephone, email, internet, mobile phone, fax, or any other means.
A participant is any natural or legal person who uses services provided by the Service Provider or who has registered with the Service Provider to obtain such services.
By using one or more services, the participant irrevocably agrees to the application of these GTC. These GTC also apply in full and, where applicable, additionally or differently, to courses abroad or yoga holidays/retreats.
2. GENERAL PROVISIONS
2.1
The following General Terms and Conditions are deemed agreed for the implementation of all yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
At the latest upon binding registration, these General Terms and Conditions become legally binding and are deemed accepted and agreed by the course participant.
2.2
Amendments to these General Terms and Conditions are generally excluded. In the case of differing special agreements, such amendments shall only be valid if they have been agreed in writing.
Any such agreed amendments to the General Terms and Conditions shall apply only to the respective legal transaction and expressly not to any subsequent transactions or new registrations after the completion of yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., or the respective event, as comprehensively referred to in Section 2.1.
3. SCOPE OF SERVICES
The services include the organisation and implementation of yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
4. COSTS, PRICES AND PAYMENT TERMS
4.1
The current prices for yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., can be found at www.rafaelserranoyoga.com, in brochures and flyers, or will be provided in writing upon request.
4.2
Registrations for all offers become legally binding upon submission by email, online reservation, SMS, WhatsApp, post, or reservation payment.
Registrations made by telephone will be confirmed by email. Upon receipt of the confirmation email by the participant, such registrations also become legally binding and may be invoiced.
Once the registration has been received by us, we will send the participant a reservation confirmation email and, at the same time, an invoice for payment of the course. RAFAEL SERRANO YOGA charges an administrative fee of CHF 10.00 for issuing the invoice. The payment deadline stated therein is binding. Failure to pay the course fee does not constitute cancellation.
By making an online booking and/or submitting the registration, the participant expressly confirms that they waive any right of withdrawal pursuant to Art. 40a–40f of the Swiss Code of Obligations (CO). This applies in particular to distance contracts, such as retreats, trainings and workshops, as the organisation of these events involves considerable preparation and planning.
4.3
Full payment for yoga lessons/subscriptions must be made before the start of the lesson. Unless otherwise agreed or stated, payment is made on the first day of the course at the studio in cash or online via app and bank transfer.
5. CONDITIONS AND CANCELLATION TERMS (REFUNDS)
5.1 Yoga Classes
Registrations that have already been made may be cancelled no later than 24 hours before the start of the class by email or via the online booking tool.
Registrations and cancellations by telephone, SMS or WhatsApp cannot be accepted.
In the event of late cancellation or no-show, the class will be deducted from the subscription without further notice or the single class fee will be invoiced to the participant and will become payable.
Persons with monthly subscriptions who repeatedly register but do not attend lose their reservation right.
Classes may also be attended without prior registration. In this case, we recommend arriving at the studio at least 30 minutes before the start of the class and paying the single admission fee in cash before the yoga class. RAFAEL SERRANO YOGA cannot guarantee available places.
5.2 Yoga Subscriptions
Yoga subscriptions expire after their validity date, are personal and non-transferable. Yoga subscriptions are valid from the date of purchase.
Paid course fees for subscriptions are non-refundable.
Monthly subscriptions may be paused due to holidays or absence for professional reasons lasting continuously longer than two (2) weeks, for the respective stated duration, provided that this absence is communicated in writing in advance. Retroactive pauses are not possible.
In the event of illness, accident or pregnancy, provided that no services were used during the certified period, the validity period of all subscriptions may be paused accordingly upon presentation of a medical certificate.
A copy of the medical certificate must be submitted in writing to the teaching staff during the current validity period of a booked monthly subscription and during the certified period of illness. Otherwise, there is no entitlement to a refund of the booked monthly subscription.
Changes to the timetable or teaching staff may occur at any time. Such changes do not give rise to any entitlement to a refund.
Lost subscription cards or weekly passes will not be replaced.
5.3 Yoga Workshops, Yoga Trainings, Yoga Trips
If a participant is unable to attend a yoga workshop, yoga training or yoga trip, the participant always has the option of finding a replacement person. This must be communicated in writing by email, stating the replacement person’s first name, surname and email address.
Cancellations involve administrative effort. Alternatively, depending on the time of cancellation, the course fee may be partially waived.
Cancellations must be communicated in writing. Any waiver or refund of the course fee in the event of cancellation before the start of the course or depending on the time of cancellation shall be governed by the respective participation terms set out in the contract for the relevant course or training.
In any case, an administrative fee of 15% of the reserved service will be charged.
Yoga workshops, yoga trainings and yoga trips that are not attended cannot be made up and will not be refunded.
In the event of absence due to illness, professional commitments or other reasons, or in the event that a yoga workshop, yoga training or yoga trip is discontinued by the participant or by the Organiser, there is no entitlement to any reduction or refund of the course or training fees.
5.4 Failure to Pass the Yoga Teacher Training Examination, Examination Retake
If a participant does not pass the final examination of the yoga teacher training, they have the option to retake the final examination.
An additional fee of CHF 450.00 will be charged to the participant for this. The additional examination weekend provided for this purpose will be communicated to the participant by the course management in writing by email.
5.5 Private Lessons – Coaching – Massages
Cancellations of private lessons, coaching sessions and massages are only accepted if the relevant information is received by email at least 24 hours before the start of the appointment.
5.6
The course management reserves the right, in the event of illness or unforeseen circumstances, to cancel yoga classes, including at short notice, or to arrange for a suitably qualified person to substitute.
Participants will be informed as quickly as possible by email or SMS of any cancellation, except in cases of unforeseeable cancellations.
In the event of course cancellation, subscriptions may be extended accordingly.
5.7
In order to conduct our courses under optimal conditions, we define a minimum and maximum number of participants depending on the respective event/course.
If the number of participants is insufficient, the course will generally not take place and the course fees will be refunded.
6. ABILITY TO PARTICIPATE, PERSONAL RESPONSIBILITY
6.1
Participation in all yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., requires personal responsibility as well as normal psychological and physical resilience and fitness.
In the case of acute physical or psychological problems, a doctor should be consulted in advance to determine whether yoga classes are advisable at that time.
Yoga courses may have a beneficial effect on physical, mental and psychological well-being. However, they do not constitute medical or psychotherapeutic treatment.
6.2
Existing psychological or physical health limitations, as well as an existing pregnancy, must be reported to the course management no later than at the beginning of the yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
If a health limitation or pregnancy occurs during the course of yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., the course management must be informed immediately.
Each participant takes part in these courses/events on their own responsibility. It is therefore also at the discretion of the respective participant to seek medical advice before participating in yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
If a participant has doubts about their physical or psychological suitability to participate, they are in any case advised to seek appropriate professional advice before registering.
6.3
If, during yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., the course management identifies a health limitation, or if, within the meaning of personal responsibility, a participant violates or disregards the house rules of Rafael Serrano and RAFAEL SERRANO YOGA, the course management reserves the right to immediately discontinue contractual services towards the participant and/or to exclude the participant from the yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
7. LIABILITY / INSURANCE
7.1
Insurance is the responsibility of the participants.
The classes are designed for healthy adults. Participants are obliged to inform the yoga teacher of any injuries, physical complaints or limitations.
Rafael Serrano and RAFAEL SERRANO YOGA accept no liability for accidents or damages.
Any further liability, in particular under the title of compensation for damages, is expressly excluded.
The Organiser therefore accepts no liability of any kind, in particular no liability in the event of failure to disclose any physical or psychological conditions which would make participation in yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., inadvisable, or in the event of violation or disregard of the house rules.
The course management reserves the right to refuse participants if it is of the opinion that the health-related or psychological requirements for participation in yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., are not met, or to exclude the participant from yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., in the event of violation or disregard of the house rules.
Such refusal may also take place at short notice or even during ongoing yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc.
In the event that the participant is refused participation before starting yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., the course fee will be refunded to the participant on a pro-rata basis.
7.2
The use of the course premises and offers is at the participants’ own risk.
No liability is accepted for valuables brought along by participants.
7.3
For all yoga courses, yoga lessons, private yoga classes, business yoga, yoga workshops and trainings, yoga holidays/retreats, community events in Switzerland and abroad, etc., organised by RAFAEL SERRANO YOGA, we exclude any liability for damages incurred.
Participants are therefore responsible for ensuring sufficient insurance coverage.
RAFAEL SERRANO YOGA cannot be held liable for theft or loss of objects.
8. COVID-19 EXCEPTIONAL SITUATION
8.1
Pursuant to Section 7.1 of these GTC, the services provided by Rafael Serrano and RAFAEL SERRANO YOGA consist of yoga instruction designed for healthy adults.
Upon entering the premises of Rafael Serrano and RAFAEL SERRANO YOGA, the participant undertakes to comply with the house rules and acts on their own responsibility towards themselves and their fellow human beings, with common sense and full awareness.
The following rules must be observed and correspond to the legal regulations of the Swiss Federal Office of Public Health (FOPH):
- Additional masks will be made available in the kitchen with immediate effect, one mask per participant.
- Washing and disinfecting hands is mandatory:
- after entering the studio;
- after using the toilet;
- after using tissues;
- after changing sweaty clothes and personal items.
- Lunch must be eaten outside the studio.
8.2
The participant is obliged to comply with the rules.
The course management reserves the right to exclude the participant from the school in the event of non-compliance.
8.3
In special situations, the course management reserves the right, upon entry to the premises of Rafael Serrano and RAFAEL SERRANO YOGA, to request participants to provide a negative rapid test.
9. PLACE OF PERFORMANCE, PLACE OF JURISDICTION, APPLICABLE LAW
9.1
The registered location of the yoga school, Bärschwilerstrasse 6a, 4053 Basel, is agreed as the place of performance for all obligations.
The place of performance is therefore Basel-Stadt/BS.
9.2
Swiss law applies.
For any disputes, a Basel conciliation authority shall be consulted in the first instance.
If further disputes cannot be resolved by the conciliation authority, the exclusive jurisdiction of the respective court in Basel-Stadt is agreed, within the scope of its respective jurisdictional competence.
9.3
Should individual provisions or parts of these General Terms and Conditions or any individual contracts to be concluded be or become void, invalid or contestable, the remaining provisions or parts thereof shall remain unaffected.
They shall then be interpreted or supplemented in such a way that the intended economic purpose is achieved as precisely as possible from a legal perspective.
9.4
No verbal ancillary agreements are made.
Amendments and additions to these GTC and to all membership contracts must be made in writing.
10. DATA PROTECTION
The course management undertakes to treat personal data and information confidentially and not to pass them on to third parties.
Excluded from this is the disclosure of data to employees and business partners for organisational reasons.
Likewise, the participant undertakes to treat information about other course participants confidentially.
11. MISCELLANEOUS / OTHER PROVISIONS
RAFAEL SERRANO YOGA uses photos from events on its own website or on Facebook and Instagram, on which participants may possibly be recognisable.
If this has occurred against the will of a person, that person may instruct RAFAEL SERRANO YOGA to remove their person from the image.
No further or separate claims may be asserted.

These GTC apply exclusively to the business area not protected by consumer law pursuant to Art. 8 et seq. of the Swiss Code of Obligations (CO).
